What Is the Bayer Antifungal Spray Settlement?


A class action lawsuit — Huertas et al. v. Aeropres Corp., et al., Case No. 2:21-cv-20021 — was filed in the United States District Court for the District of New Jersey. The lawsuit alleged that Bayer sold Lotrimin® and Tinactin® spray products that were contaminated with benzene, a known carcinogen, and that consumers were not properly informed. Bayer issued a voluntary recall in October 2021 affecting products with lot numbers beginning with TN, CV, or NAA, distributed between September 2018 and September 2021.

Rather than go to trial, the parties agreed to a $4.85 million settlement fund. Bayer denies all wrongdoing, but the settlement provides real cash payments to consumers who purchased these products — including those who no longer have their receipt or proof of purchase.

How to File Without a Receipt — Step by Step

Confirm You Qualify

Make sure you are a U.S. resident who purchased at least one of the 9 qualifying Lotrimin® or Tinactin® spray products on or after November 16, 2015. You don’t need the physical product or packaging.

Fill Out the Claim Form

Submit your claim electronically by 11:59 p.m. Hawaii-Aleutian Standard Time on March 11, 2026, or mail it postmarked no later than March 11, 2026 to the Settlement Administrator.

No. Filing a claim simply means you are participating in the class action settlement and receiving your share of the settlement fund. However, by staying in the class (i.e., not opting out), you agree to release Bayer and the other defendants from future claims related to these products. Note: personal injury claims are not released by this settlement.
Any payment you received through Bayer’s Recall Program will be offset (deducted) from your settlement payment. However, if you already received three payments under the Recall Program and purchased additional products, you may still be eligible for one No Proof-of-Purchase payment.
Yes. If you want to preserve your right to sue Bayer independently, you may opt out by mailing a written exclusion request to the Settlement Administrator, postmarked no later than March 11, 2026. However, if you opt out, you will not receive any cash payment from this settlement.
Payments will be processed after the Court grants final approval at the hearing scheduled for May 13, 2026. If there are no appeals, the Settlement Administrator will begin processing approved claims within 90 days of final approval. Payments may take several months after the claim deadline.
