What Is the Bayer Antifungal Spray Settlement?
A class action lawsuit — Huertas et al. v. Aeropres Corp., et al., Case No. 2:21-cv-20021 — was filed in the United States District Court for the District of New Jersey. The lawsuit alleged that Bayer sold Lotrimin® and Tinactin® spray products that were contaminated with benzene, a known carcinogen, and that consumers were not properly informed. Bayer issued a voluntary recall in October 2021 affecting products with lot numbers beginning with TN, CV, or NAA, distributed between September 2018 and September 2021.
Rather than go to trial, the parties agreed to a $4.85 million settlement fund. Bayer denies all wrongdoing, but the settlement provides real cash payments to consumers who purchased these products — including those who no longer have their receipt or proof of purchase.
Cash per qualifying product claimed — up to 3 units per household
Maximum payout without a receipt: $21 per household | With a receipt: full purchase price per itemFree to file · Takes under 5 minutes · Deadline March 11, 2026
Do You Qualify?
Qualifying is simple. You are a Settlement Class Member if both of the following apply to you:
- You reside in the United States.
- You purchased one or more of the qualifying Bayer Products (listed below) on or after November 16, 2015.
Which Products Are Covered?
The following Lotrimin® and Tinactin® spray products are included in the settlement. These are the products subject to Bayer’s October 2021 recall (lot numbers beginning with TN, CV, or NAA, distributed September 2018 – September 2021). Purchases made as far back as November 16, 2015 are eligible.
Receipt vs. No Receipt — What’s the Difference?
There are two ways to claim. The No Proof-of-Purchase path is the easiest — you simply attest under penalty of perjury that you made the purchase. Here’s how the two options compare:
| Claim Type | What You Need | Payout | Max Units |
|---|---|---|---|
| With Proof of Purchase | Receipt, bank/credit card statement, or other purchase documentation | Full purchase price (excl. tax) per item | No stated cap |
| ⭐ No Proof of Purchase | Just your sworn statement — No Receipt Needed | $7 per product | 3 units per household ($21 max) |
No receipt · No hassle · $7 per product, up to $21
